Call for international solidarity with HSE community
The students of The Higher School of Economics may be writing their last open letter in response to the shifts in their university's policy towards the freedom of extracurricular organizations. Changes in the internal regulations and some other documents were introduced on January the 16th. New regulations impose restrictions on activities which "do not positively contribute to the university's reputation" as well as effectively prohibit any political or human rights activism, making any violation of these regulations a disciplinary offense which can lead to expulsion. These changes have already become a matter of widespread concern for student organizations as they are considered to be an act of reprisal for the students' involvement in the summer 2019 protests in Moscow.

The HSE community is asking our international colleagues from academia to sign the following letter of solidarity with the students below and leave comments in support of academic freedom.

This summer, Moscow was shaken by large protests for free elections of Moscow City Council. HSE Vice Rector and pro governmental candidate Valeria Kasamara was suspected of misuse of HSE resources for her election campaign. The protests resulted in thousands of peaceful protestors being detained, 19 people were criminally convicted of various crimes while 11 were sentenced to an average prison term of three years. Among the detainees and those under criminal investigation were many students including HSE student Yegor Zhukov. The movement supporting the detainees was partly organized and supported by students and alumni of the Higher School of Economics, a state university that has built its reputation on the promotion of liberal values and support for student initiatives and autonomy. However, once the protests winded down, the university administration shifted towards shutting down dissident voices in the community, implementing restrictions on freedom of speech, freedom of assembly, and freedom of association and political activity within and outside of the university for its students. At the same time, these new regulations are not to be applied to HSE officials which stand on pro governmental political positions.

First of all, the new regulation forbids student media to register as student organisations, de facto depriving them from access to university resources, facilities and platforms. Currently, student news outlets created and operated by HSE students are very diverse, but remain largely critical towards the political situation in the country and sometimes to the university itself. The newly-introduced amendment is attempting to deprive the student community of their voice, to potentially fake the students' opinion, and to cut down on the criticism expressed by the student media. We suppose that this amendment simply violates the university's Statement of Values which guarantees the freedom to express opinions.

Secondly, new regulations stipulate limitations on public speech "on behalf of the undefined group of students or university staff", forbid student organisations to "run any human rights activities" in addition to already existing ban on political activities, and introduce obligation to "avoid affiliation with the university in case of political activity". These regulatory innovations exclude the possibility of writing or signing open letters on behalf of HSE students/staff or raising money to support those under prosecution as an act of corporate solidarity - the whole range of activities which may be regarded as "political or human rights activism" (the exact list of activities is not specified). All in all, under these regulations students' solidarity and self expression become a disciplinary offense.

Thirdly, new regulations obligate to "use the space of the university solely for its prescribed purpose". This vague definition enables the administration to cancel almost any event or arrangement, which may be deemed contradicting to their current approach of cherishing university's reputation and values. In addition to that, a special obligation is introduced, which requires students to show their ID on first demand of a security guard or university officials. This kind of excessive supervision does not comply with the statement of values and has no legal basis. Even police does not possess such a warrant unless they state a legitimate reason for such an ID check.

Therefore, students of HSE are now making the following demands:

  1. Not to enact the proposed amendments to the regulations;

  2. End the censorship of students' and students' associations activities;

  3. End the ban on human rights activities for students and student associations;

  4. Allow and guarantee strict autonomy and editorial independence of student media;

  5. Allow and guarantee the full freedom of speech and expression;

  6. Adopt a new interpretation of "political neutrality" in the Statement of Values, which prohibits university to be politically active but not its students; currently under this rule university officials effectively prohibit all kinds of political activities of its students and student organisations. It should be prohibited for the university to prevent political discussions from occurring as well as the engagement of politicians in the university's public events (talk-shows, discussions, seminars, etc.)

Academic life is founded on the communication and exchange of ideas. If channels of communication are being shut down, then there will be no possible growth as the quality of research and education will inevitably deteriorate. We believe values of free speech, assembly and association have to be paramount when it comes to the rights of students. HSE motto reads Scholae Sed Vitae Discimus (We Study Not for School, but for Life), but life outside the university walls differs drastically from what occurs inside because of administrative censorship, rendering this slogan to be nothing more than a pretty catchphrase.

The HSE community is asking our international colleagues from academia to sign the following letter of solidarity with the students below and leave comments in support of academic freedom. We ask you to show and prove to HSE administration, that proud demonstration of affiliation with one's University is an important part of one's identity. We should not be losing the right to participate in public campaigns as students, alumni or professors of Higher School of Economics.

The open letter should be signed before January, the 24th, the day the Academic Council has its session. It would have been of great value if you could write a letter of support from the community of your own university and send it to us before the above mentioned deadline. This letter with all signatures and comments will be passed to HSE Administration during Academic Council session.

The value of higher education is in its ability to prepare students to think critically and engage deeply in the issues facing our generation. Any effort to discourage free speech directly contradicts the purpose of higher education. It is harmful to current and future generations to limit their active engagement in social and political events, because that engagement is the application of their education. If a university is not encouraging students to engage in their political climate according to their personal views, they are not educating—they are brainwashing.

I emigrated to Poland 3 years ago because of accelerating degradation of civil, law enforcement and political institutes as well as violation of civil rights in Russia. I am sure, that the debated decision is not being a question of life and death for the University. So nowadays HSE administration has a chance to decide: whether it will take act towards making political and civil rights environment in Russia worse, or it will withhold itself from collaboration with forces, which undermine the prosperous future of Russia.

The new restrictive measures create an additional difficulty for all the counterparts of the university dynamics to communicate and to collaborate. Why? As for professors, instead of implementing a working regulatory mechanism, they extend the "grey zone" of speech and public action which cannot be in fact evaluated procedurally or ethically in a non-arbitrary way. For students, they restric a possibility of associative and collaborative activities. Being a reactive set of measures which follows a momentary apprehension, these modifcations threat to harm the unviersity design for years in advance. In view of negative impact on university culture, I ask you not to introduce the intended modifications and let the intellectual self-regulation act instead.
